Terms of Service

1. Eligibility

You must be at least 18 years old to create an account and purchase a membership. If you are between the applicable minimum age and 18, you may use the Service only under the supervision and with the consent of a parent or legal guardian who agrees to these Terms on your behalf. By using the Service you confirm that you are legally able to enter into a binding agreement under Indian law, and that the information you provide is accurate.

2. Your account (Koovira SSO)

The Gym uses your single Koovira account for sign-in (single sign-on). You do not create a separate The Gym login; instead you authenticate through Koovira, and your identity, wallet and data are shared securely across Koovira services under Koovira’s standards. You are responsible for keeping your Koovira credentials safe and for all activity under your account. Notify us promptly of any unauthorised use. One account is intended for a single individual and should not be shared.

3. The Service — what it is (and is not)

The Gym provides AI-powered fitness and wellness guidance — including workout and Indian diet plans, a daily coach, yoga and mobility routines, progress tracking, calculators and a partner-gym network — generated with the help of Koovira’s BRAMHA AI.

The Service is not medical advice. The Gym does not provide diagnosis, treatment, or the services of a doctor, physiotherapist, dietitian or other licensed healthcare professional. AI-generated plans and coaching are general information based on the details you supply and may not be suitable for your specific health condition. Always consult a qualified doctor before beginning any exercise or nutrition programme, especially if you are pregnant, recovering from injury or surgery, or have any medical condition. 4. Membership plans & pricing

The Gym offers paid memberships. Current plans are:

All prices are shown in Indian Rupees (₹) and are inclusive of 18% GST. The applicable price, plan features and billing period are displayed on the membership page at the time of purchase. We may change plan names, features and prices from time to time; any change applies to new purchases and renewals, and we will show the current price before you confirm. A valid tax invoice is issued for each paid charge.

5. Free trial

New members may be offered a 15-day free trial of a paid plan. During the trial you get access to the plan’s features at no charge. You can cancel any time during the trial and you will not be charged. The trial is available once per member and may not be combined with other offers. If you do not cancel and choose to continue, membership begins as described below. See the Refund & Cancellation Policy for details.

6. Billing, renewal & the Koovira wallet

• Payment via the Koovira wallet. Paid memberships are billed from your Koovira wallet. You are responsible for maintaining sufficient wallet balance; wallet top-ups are governed by the Koovira wallet terms on koovira.com.
• No silent auto-charge. The Gym does not auto-renew or automatically charge you without your action. When a paid period ends, your membership continues only if you choose to renew manually. Nothing is charged again unless you renew.
• Invoicing & GST. Each charge is inclusive of 18% GST and a tax invoice is made available in your account.
• Access period. On renewal, access continues for the plan period you paid for. If you do not renew, access ends when the paid period expires.

7. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in breach of these Terms or applicable Indian law;
• share, resell, or provide your account or membership to others;
• attempt to reverse-engineer, scrape, disrupt, or gain unauthorised access to the Service, BRAMHA AI, or Koovira systems;
• upload content that is unlawful, infringing, harmful, or that you have no right to share;
• misuse AI features to generate harmful, misleading, or abusive content;
• interfere with the security, integrity, or availability of the Service.

We may investigate and take action, including suspension or termination, for any breach.

8. Content & ownership

Our content. The Gym’s original programmes, plans, text, design, software, and the BRAMHA AI system are owned by Koovira or its licensors and are protected by law. We grant you a personal, non-exclusive, non-transferable licence to use them for your own fitness journey while your account is active. You may not copy, redistribute, or commercialise them.

Your content. Content you provide — such as your health profile, notes, progress photos and community posts — remains yours. You grant Koovira a limited licence to store and process it solely to operate and improve the Service for you, as described in our Privacy Policy. You are responsible for the content you submit and must have the right to share it.

9. Health disclaimer & assumption of risk

Physical exercise carries inherent risks, including injury. The Gym provides general fitness guidance, not medical advice. You should:

• consult a qualified doctor before starting any workout, yoga or diet programme;
• stop immediately and seek medical help if you feel pain, dizziness, breathlessness, or discomfort;
• exercise within your own ability and use proper form and safe equipment.

You use the Service and follow any plan at your own risk. To the extent permitted by law, Koovira is not responsible for injury, health outcomes, or losses arising from your use of AI-generated guidance or from exercise you choose to undertake.

10. Disclaimers & limitation of liability

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant that plans or guidance will achieve any particular result, or that the Service will be uninterrupted or error-free.

To the maximum extent permitted by applicable law, Koovira and its affiliates will not be liable for any indirect, incidental, special, or consequential damages, or for loss of data, profits, or health outcomes. Where liability cannot be excluded, our total aggregate liability arising out of or relating to the Service is limited to the amount you paid to Koovira for the membership in the three (3) months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable Indian law.

11. Suspension & termination

You may stop using the Service and cancel your membership at any time as described in the Refund & Cancellation Policy. We may suspend or terminate access if you breach these Terms, misuse the Service, or where required by law. On termination, your right to use paid features ends; provisions that by their nature should survive (e.g. ownership, disclaimers, limitation of liability, governing law) will survive.

12. Governing law & jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, the courts at the seat of Koovira’s registered office in India will have jurisdiction over any dispute arising out of or relating to these Terms or the Service.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
